My Account Youth and Sports Area

These General Terms and Conditions govern the use of the "My Account Youth and Sports" e-service via the website www.commune-tunis.gov.tn.

Article 1 – Definitions

The "e-service" refers to the My Account area, which the user has access to. The "service" refers to the City of Tunis service responsible for the user database, which is used by the My Account area. The implementation of the e-service aims to allow the user to consult the e-service portal of the city of Tunis provided by the City of Tunis.

Article 2 – Purpose

The purpose of these General Terms and Conditions is to define the relationship between the Municipality of Tunis and the user, as well as the conditions applicable to any use of the My Account area. These terms may be modified at any time by the managing service. No modification will have retroactive effect. The use of the e-service implies the unconditional acceptance of this regulation, with no possibility of complaint for any reason. The user must accept these General Terms and Conditions in full, prior to using the e-service. Their consent is required and is evidenced by checking the box stating that the user has read and accepted these T&Cs. The managing service reserves the right to suspend or discontinue the e-service at any time. In case of interruption, the managing service cannot be held responsible for any consequences of this interruption for the user.

Article 3 – Use of the e-service

The user is solely responsible for the information and data they transmit to the e-service to update their account. The user must maintain confidentiality and regularly monitor the use of their access. The user is prohibited from using and transmitting any term or data that may constitute crimes or offenses under the applicable Tunisian legislation, including incitement to discrimination, hatred, or violence, attacks on the authority of justice and public morals, defamation or insult, and invasion of privacy.

3.1 Account Creation

The user creates an account by logging into the e-service on the homepage.

3.2 Consent Management

In the "My Information" section, the user can, at any time, give or withdraw their consent for receiving communications from the City of Tunis to the contact email provided by the user. This may include regular communication (newsletter) or occasional communications of a general nature.

3.3 Request Tracking

The user can track their requests with the City of Tunis in relation to e-services linked to My Account in the "My Account" section.

Article 4 – Management of Personal Data

In the "My Information" section, the user can record their personal data. This registration is done at the user's initiative, after obtaining their consent. The personal data recorded will only be used for verification purposes. Personal data subject to this account creation will be processed in accordance with the legal rules for personal data protection as set forth by Organic Law No. 63 of 2004 dated July 27, 2004, and the applicable regulations on personal data protection in Tunisia. The user has the right to access the data recorded in their account. In case of failure by the requester to comply with these General Terms and Conditions, the Municipality of Tunis reserves the right to delete the concerned account unilaterally and without compensation.

Article 5 – Responsibilities and Guarantees

5.1 – The user is solely responsible for the use of their account. Any connection, request, or data transmission made from their account is deemed to have been done by the user and under their full responsibility. In case of loss, theft, or misuse of their ID, the user must promptly inform the Municipality of Tunis. The Municipality of Tunis cannot be held responsible for any damage resulting from an interruption, malfunction, suspension, or cessation of the e-service for any reason or for any material or immaterial damage arising from the connection. 5.2 – The use of the e-service implies acceptance of the characteristics and limitations of the Internet network, particularly with regard to technical performance, response times for consultation, the risks associated with the connection, the absence of protection of certain data against potential misuse, and the risks of contamination by viruses circulating on the network. The Municipality of Tunis cannot be held responsible for malfunctions affecting the Internet network, any configuration issues, or any browser-related problems. The Municipality of Tunis does not guarantee that the e-service will operate without interruption. The responsibility of the Municipality of Tunis cannot be sought if, due to force majeure or events beyond its control, it must suspend the e-service, shorten it, or change the terms of use. The Municipality of Tunis disclaims all responsibility for situations where the e-service becomes unavailable, or in cases of malfunction caused by circumstances beyond its control, or if the information provided by users is destroyed for reasons not attributable to it. The Municipality of Tunis cannot be held responsible for any material or immaterial damage caused to internet users, their computer equipment, and the data stored on them, or for any direct or indirect consequences resulting from such damage.

Article 6 – Archiving and Proof

The Municipality of Tunis is solely responsible for archiving data transmitted through the e-service. Only the elements that have been archived can be used as evidence in resolving any dispute between the requester and the managing service. In particular, the different versions of the General Terms and Conditions are electronically archived by the services of the Municipality of Tunis to give them legal value.

Article 7 – Complaints

Any complaints can be submitted via the "Complaint" form available on www.commune-tunis.gov.tn.

Article 8 – Intellectual Property

The images, texts, software, and other content and components are the property of the Municipality of Tunis or its partners and may be protected by intellectual property rights. Any representation, reproduction, adaptation, translation, redistribution, in whole or in part, and its content by any means, without prior and express authorization from the Municipality of Tunis, is prohibited and may constitute infringement under Tunisian law and the intellectual property code. Access does not grant the user any intellectual property rights relating to the e-service or its content. The insertion of any simple or hypertext links is strictly prohibited without written and prior agreement from the Municipality of Tunis.

Article 9 – Sanctions

The managing service reserves the right to take any measure deemed appropriate against any user who, in its opinion, violates the provisions of the applicable legislation or these T&Cs. These measures may include, among others, one or more warnings addressed to the user in question, their exclusion from the e-service, or legal action.
